Hooters Gas Card Sweepstakes
NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE DOES NOT IMPROVE CHANCES OF WINNING. THE FOLLOWING SWEEPSTAKES IS VALID ONLY IN THE FIFTY (50) UNITED STATES AND DISTRICT OF COLUMBIA (D.C.), AND IS OPEN ONLY TO ELIGIBLE ENTRANTS AS DESCRIBED IN THE RULES BELOW. BY PARTICIPATING IN THIS SWEEPSTAKES, YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES AND THE DECISIONS OF SPONSOR AND ADMINISTRATOR. VOID ELSEWHERE AND WHEREVER PROHIBITED. DO NOT PARTICIPATE IN THE SWEEPSTAKES IF YOU DO NOT AGREE TO THESE OFFICIAL RULES AND FALL WITHIN THE ELIGIBILITY REQUIREMENTS AS SET FORTH BELOW.
Sweepstakes Name: Hooters Gas Card Sweepstakes (the “Sweepstakes”).
Sweepstakes Dates: Sweepstakes is scheduled to begin at 12:00:01 am Eastern Time (“ET”) on 5/18/2022 and ends at 11:59:59 pm ET on 7/29/2022 (the “Sweepstakes Period”). The Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void outside of the (50) United States and D.C., and wherever prohibited or restricted by law.
Who May Enter: Sweepstakes is open only to legal residents of, and who are physically located within, the fifty (50) United States and District of Columbia, who are age eighteen (18) or older, as of date of entry, and have a valid driver’s license or government issued photo ID, except the following persons who are not eligible to enter or win:
- Employees, officers, and directors of Hooters Restaurants, Hooters of America, LLC (collectively “Sponsor”), Million Dollar Media (the “Sweepstakes Administrator”), and each of their respective franchisees, parents, affiliated companies, subsidiaries, distributors, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the design or execution of this promotion (collectively, “Released Parties”), and the members of the immediate families or households, whether or not related, of any of the above. “Immediate family members” includes, for purposes of this promotion, parents (including in-laws), grandparents, siblings (including step-siblings), children (including step-children), grandchildren (including step grandchildren) and each of their respective spouses, regardless of where they reside.
How to Enter: There are two (2) ways to enter the Sweepstakes: (1) download the Hooters app and create a new account (no purchase required), or (2) entry via mail (no purchase required), as outlined below. There is a limit of one (1) entry per person during the entire Sweepstakes registration period, regardless of method of entry.
- Download the Hooters App and create new account (no purchase required): Download the Hooters app through the application store on your mobile device (i.e. Apple App Store or Google Play Store), then follow the instructions to create a new account within the App with all required information including a valid email address. After having read and agreed to these Official Rules, click the submit button to create your new account within the Hooters App and to receive one (1) automatic entry into the Sweepstakes drawings (see below). All entries must be fully complete with all required information. The Hooters application is free, and Hooters’s Terms of Use apply. If you enter using a mobile device on a wireless service provider’s network (as opposed to a Wi-Fi network), your carrier’s text and data rates will apply. You should consult your wireless service provider’s pricing plan for details. You agree to incur any and all charges demanded by your wireless carrier. All new account registrations must be completed by 11:59:59 pm ET on 7/29/2022 to be eligible.
- Mail-In Entry (no purchase required): To enter by mail, you must legibly hand-print on a 3” x 5” card or piece of paper your first and last name, complete address (including city, state and zip code), valid email address, age, and phone number (including area code). Mail completed 3” x 5” card or piece of paper in a #10, business-size envelope with first-class postage affixed to: Hooters Gas Card Sweepstakes, P.O. Box 278, Woodbridge, NJ 07095. Mailing envelopes received with more than one entry inside will be disqualified and none of the entries in the envelope will be included in any prize drawings. Information on all entries must be hand-printed. Incomplete or illegible entries will be disqualified. All mail-in entries must be postmarked by July 29, 2022 and received by August 3, 2022 to be eligible.
Maximum of one entry per person, regardless of method of entry. Any duplicate entries received shall be disqualified. Each participant must submit an entry on his/her own behalf. Any entry submitted on behalf of another individual or using another person’s name, email address, or providing any false email addresses or information, will be disqualified and ineligible to claim any prize. Any attempt by any participant to obtain more than the stated number of entries allowed by using same, multiple/different emails, identities, or any other methods void that participant's entries and that participant may be disqualified. No mechanically produced or automated entries permitted. Use of any automated system to participate is prohibited and will result in disqualification and all such entries will be deemed void. False and/or deceptive entries or acts, including misrepresentation of age, shall render such entries ineligible. All entries become the sole property of Sponsor and will not be acknowledged or returned.
By participating and submitting an entry, entrant agrees that Sponsor, Administrator and participating parties are authorized to contact entrant via email, mail, phone or any other form of media to make entrant aware of information pertinent to the Sweepstakes, and to distribute information regarding the Sponsor(s) featured products, discounts, special events or promotional offers. Entrants may opt-out of any further email communication at any time by simply replying REMOVE to any email message, or following the provided opt-out instructions. Any available opt-in opportunities are not required to enter the Sweepstakes, and checking the opt-in boxes will not improve your chances of winning. By opting in, participants agree to join the Hooters Email Club. Entrants may opt out of Hooters Email Club membership at any time by replying UNSUBSCRIBE to any email message, or following provided opt-out instructions. All information submitted to Sponsor as part of this Sweepstakes will be treated in accordance with Sponsor’s privacy statement, available at https://www.hooters.com/privacy-policy. Entrants must fully complete and submit all non-optional data requested on the online entry form to be eligible. Entrants have the right to withdraw and correct their personal data, but entrants are not allowed to re-submit their entries. Directions on procedures for submitting corrections to personal data are provided in the privacy policy of Sponsor.
All entries must include all required information. Any Hooters App new account entry or mail-in entry with incorrect, incomplete or illegible information, an invalid email address or other inaccurate information will be disqualified. In the event of a dispute as to any entry, registration or submission, the authorized account holder of the email address, used to register and associated with the entry will be deemed to be the registrant and s/he must be eligible according to these Official Rules. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Proof of being the authorized account holder may be required.
Sponsor reserves the right, in its sole discretion, to disqualify any individual (and all of his or her entries) who tampers or attempts to tamper with or abuse the entry process in any way or who is otherwise in violation of these Official Rules, as determined by Sponsor or Administrator in their sole discretion. Any questions regarding the number of entries submitted or the authorized account holder shall be determined by Sponsor in its sole discretion. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THE SWEEPSTAKES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Winner Selection and Notification: Potential winners will be chosen in a series of random drawings from among all eligible entries received from all entry methods combined as of the date and time of each drawing to be held on or about 6/1/2022, 7/1/2022, and 8/4/2022, to select up to a maximum total of two hundred (200) potential grand prize winners (see prize description below). A total of sixty (60) winners shall be selected on or about 6/1/2022 and 7/1/2022, and a total of eighty (80) winners shall be selected on or about 8/4/2022, for a total of two hundred (200) winners.
- Note: There is a maximum of one (1) prize award per person, email address or household during the entire Registration Period. A maximum of one hundred (100) prizes will be awarded to residents from any individual eligible state. If eligible entries are less than the scheduled number of prizes for the Sweepstakes, then associated prize award(s) shall not be awarded.
All potential prize winners shall be notified via email following their selection and determination as a potential winner, to the email address associated with their selected entry. Entrants are solely responsible for checking their email for any notification including junk or spam folders. Sponsor shall not be responsible for any incorrect email addresses provided at the time of registration, failure in delivery of any notification email due to spam filter, junk, quarantine or any other failure of delivery or receipt for any reason.
If a potential winner fails to respond, or the Administrator is unsuccessful in its attempt to reach a selected potential winner via email notification for any reason, within seventy-two (72)-hours from the initial notification attempt to the email address associated with that participant’s entry, then that participant may be disqualified and the associated prize shall not be re-awarded, except as noted herein. During winner notification process, the selected potential winner must confirm their eligibility, and indicate their willingness and ability to accept the designated prize award (see below). If any selected winner does not meet the eligibility requirements, or is unable or unwilling to accept the associate prize or elects to decline the prize, s/he will be disqualified. Any disqualified contestant will not receive any alternate prize substitution or compensation. Decisions of the Administrator in the selection and determination of all potential prize winners, and all matters relating to this Sweepstakes are final and binding.
To be eligible for a prize, each winner shall be required to: 1) complete and return in the manner as instructed by the Sweepstakes Administrator (via online submission), within three (3)-days of notification, a prize acceptance form, including an affidavit of eligibility and a liability/publicity release (publicity release where permitted); 2) if requested by Sponsor or Administrator, present a copy of a valid social security card and/or a valid driver’s license or government issued photo ID with residential address as a condition of receiving any prize; and 3) pay all applicable taxes (including, but not limited to, all local, state and federal taxes) on all prizes awarded.
Grand Prize Award – Maximum of (200) prize awards available: Each grand prize consists of one (1) $50.00 gas gift card, awarded in the form of a gift card from the Sponsor designated gasoline retailer. Gift card subject to the terms and conditions of the issuing gasoline retailer gift card policy. Approximate retail value (ARV) of each prize award: $50.
Prize winners must accept delivery of prize in the method as solely determined and designated by Sponsor. Prize shall be shipped only to the designated winner residential address as submitted during initial online registration and/or as provided during winner notification, via the carrier as determined and designated by Sponsor (i.e. UPS, USPS or other Sponsor designated carrier), or as otherwise specified by Sponsor. In the event of an e-gift card delivery, gift card shall be emailed to the email address provided at time of initial registration. Allow 8 – 12 weeks for prize delivery.
Once shipped (or delivered via email), prize shall be considered as awarded and delivered, and Sponsor shall not be responsible for actual receipt of delivery by winner. Sponsor shall not be responsible for any lost, late, undelivered, misdirected, damaged or stolen delivery; or any incorrect delivery address provided by winner during registration or prize claim. In the event of any delivery issues, including undelivered, misdirected, lost or stolen deliveries, Sponsor shall have no responsibility to replace the prize award, and prize award shall not be substituted by Sponsor with any alternate prize award or compensation. Winner shall look solely to designated shipper/carrier for any lost, damaged, stolen or mis-delivered packages and not to Sponsor for any delivery issues.
General Prize Conditions: Any and all costs or expenses related to prize acceptance, redemption, use and delivery not specified herein as being included in the prize are the winner’s sole responsibility, including but not limited to delivery fees, sales tax, gratuity, and all applicable taxes (including, but not limited to all local, state and federal taxes). All prize awards are non-transferable, and no cash redemption or prize substitution allowed, except at Sponsor’s sole discretion or as provided herein. Sponsor reserves the right to substitute a prize with one of comparable or greater value, at its sole discretion. Failure to collect or properly claim prize in accordance with these rules will result in forfeiture of the prize. All properly claimed prizes will be awarded. Any unclaimed prizes will not be awarded. Maximum ARV all available prize awards: $10,000.
Additional Rules & Restrictions: By participating, entrants agree to abide by and be bound by the Official Rules and the decisions of the Sponsor and Administrator, which shall be final in all matters relating to this Sweepstakes. In the event an entrant wins a prize and is later found to be in violation of these Official Rules he/she will be required to forfeit the prize or to reimburse Sponsor for the stated value of the prize if such violation is discovered after winner has used the prize. Participation in Sweepstakes constitutes permission for the Sponsor and its designees to use entrants’ names, cities and states of residence and/or likenesses for purposes of advertising and trade in any and all media now or hereafter known worldwide on perpetuity without limitation or further compensation, notification or permission, unless prohibited by law. False, fraudulent or deceptive entries or acts shall render entrants ineligible for any prize.
By participating, entrants agree to hold all Released Parties harmless from any and all claims, losses, actions, or damages of any kind, whether actual, incidental or consequential, for injury (including but not limited to death), damages, losses or expenses arising out of or relating to entrant’s participation in this Sweepstakes, or the acceptance, possession or use/misuse of any prize, or participation in prize-related activities (including but not limited to travel or activity related thereto), and to assume all liability therefor, including, but not limited to (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Sweepstakes; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or land line phone service; (f) any injury, or loss (including death) to persons or property of any kind, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or from the receipt, use or misuse of any prize (including, without limitation, attorneys’ fees, claims, costs, personal injuries, losses and damages related to personal injuries, death, damage to or destruction or property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional, under a theory of contract, tort (including negligence), warranty or other theory); and (g) any claims based on publicity rights, copyright/trademark infringement, intellectual property rights, defamation or invasion of privacy and merchandise delivery.
Released Parties shall not be liable to winner or any other person for failure to supply the prize or any part thereof by reason of any acts of God, force majeure, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, pandemics, unusually severe weather, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, or any other cause beyond Released Parties’ sole control.
Entrants are restricted to use of ordinary and typical computer equipment, mobile phone equipment, Internet access and cellular networks. Sponsor disclaims all liability for the inability of an entrant to complete or continue an entry due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond the Sponsor’s control, or otherwise. The Sponsor disclaims any liability for entries not received due to technical difficulties or transmission errors. The Sponsor disclaims all liability for any delays, mis-delivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. Released Parties are not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Sweepstakes, and any injury or damage to entrant’s or any other person’s computer or mobile phone related to or resulting from participating in or downloading any information necessary to participate in the Sweepstakes. Released Parties are not responsible for any other errors of any kind, whether computer, technical, typographical, printing, human or otherwise, relating to or in connection with the Sweepstakes, including, without limitations, errors which may occur in connection with the printing or advertising of this Sweepstakes, administration or execution of the Sweepstakes, the cancellation of the game, the processing of entries or in the announcement of the prizes or prize winners. Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Sweepstakes website, acting in any manner deemed by Sponsor to be in violation of the Official Rules, or acting in any manner deemed by Sponsor to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND ITS AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH PERSON OR PERSONS RESPONSIBLE FOR SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
Sponsor reserves the right to cancel, modify, reschedule or terminate the Sweepstakes for any reason including, but not limited to acts of God, pandemics, force majeure, government regulatory action or ruling, fraud, misconduct, or if any technical failures destroy or threaten the integrity of the Sweepstakes, in the opinion of the Sponsor/Administrator, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Sweepstakes as determined by Sponsor/Administrator, in their sole discretion. In the event of early termination of the Sweepstakes, Sponsor reserves the right to determine prize winners in a random drawing from among all eligible, non-suspect entries received as of the time/date of such termination.
IN CASE OF DISPUTES: This Sweepstakes is governed by the laws of the United States and of the State of Georgia without respect to conflict of law doctrines. Unless otherwise prohibited by law, as a condition to participating in the Sweepstakes the prize awarded by this Sweepstakes, each entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and will be determined by final and binding individual dispute resolution under the applicable rules of the American Arbitration Association; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, and in no event will entrant be entitled to received attorneys' fees or other legal costs; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Georgia or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Georgia.
Odds: Odds of winning are dependent upon the total number of eligible entries received from all entry methods combined at the date and time of each prize drawing as outlined above.
